DESCRIPTION:OVERVIEW \nThe purposes and the scope of employee handbook policies and practices are changing and expanding. From a siloed HR activity that creates insular documents concerned primarily with communicating the organizational work rules and benefits\, employee handbook policies and practices have evolved into a critical component of an organization-wide management process that maximizes organizations’ achievement of business objectives\, enhances the value of their human capital\, and minimizes legal risk. \nTo increase the effectiveness of their employment policies\, organizations will have to: \n\nEnhance their business\, operational\, and legal intelligence to ensure they have identified the changing external and internal factors that affect their policies\nIncrease internal stakeholder participation in the handbook development process to obtain greater employee commitment and operational alignment\nEstablish new metrics to assess handbook policy and practices performance and measure the achievement of organization goals\nImplement internal controls that identify and alert management when employee handbook process failures occur\n\nThus employee handbooks will increasingly have to ensure that they are aligned with strategic and business objectives\, are properly drafted\, and are effectively implemented. Additionally\, they will have to: \n\nEnhance the employment brand\nPlay a key role in recruitment and retention\nEnhance employee relations\, employee morale\, and productivity\nContribute to uniform and consistent application\, interpretation\, and enforcement of organizational policies and rules\nProtect the organization against claims of improper employee/supervisor conduct\nReduce the organization’s exposure to employment-related liabilities\n\nFrom this perspective\, employee handbooks will continue to play an important role in communicating with and providing information for employees. \nWHY SHOULD YOU ATTEND?\nEmployee handbooks are a critical tool in providing important information to employees. They describe what employers expect of their employees and what employees can (should) expect from their employers. They provide critical information about employers and their workplaces and how employees are expected to fit in. \nEmployee handbooks further formalize the mutual expectations of organizations and their employees. In delineating these expectations employee handbooks create opportunities and risks for employers. Handbooks provide organizations with the opportunity to enhance the value of their human capital\, make their organizations more competitive\, and improve individual and organizational performance. Conversely\, handbooks can impede the achievement of business objectives\, increase employment-related liabilities\, and reduce managerial prerogatives by making promises or committing to certain procedural safeguards that the organization did not intend to make. As noted in the recent memorandum from the General Counsel of the NLRB: incorrectly designed employee handbooks can violate the law and have a “chilling effect” on employees’ activities. \nThus employee handbooks increasingly provide employers the opportunity to make their workforce more committed and supported of their goals. SUMMARY:An EEOC Audit May Be Coming Soon! Are You Prepared?
DESCRIPTION:OVERVIEW \nThe Equal Employment Opportunity Commission (EEOC)\, the enforcement arm for the Equal Employment Opportunity (EEO) protects employees in the workplace from discrimination with authority to investigate\, make charges\, conduct workplace audits\, and levy penalties. The EEOC also provides guidance and tools to assist certain Employers in ensuring that they do not allow or tolerate workplace discrimination. In partnership with the goals and regulations of the Civil Rights Act of 1964\, the EEOC determines enforcement initiatives every five years called\, the EEOC Strategic Enforcement Priorities (SEP). These SEPs are identified and later posted on the EEO website for all to see.\nI learned recently from an Employment Law Symposium in Florida\, that the EEOC provides this SEP along with another report called the EEO Digest Report\, a quarterly publication prepared by the Office of Federal Operations (OFO)\, which features a wide variety of recent EEOC decisions and federal court cases of interest. \nWHY SHOULD YOU ATTEND?\nAs a compliance officer\, I realized that these resources allowed me to assist my clients in staying ahead of the EEOC by learning their focus and preparing for it. SUMMARY:How to Survive an Emotionally Toxic Workplace
DESCRIPTION:OVERVIEW \nWorkplaces can be cauldrons of emotions … which can lead to the environment becoming toxic. Emotions are natural human responses to events. We’re encoded to tolerate a certain amount of emotional stress – after a point\, the emotional stress becomes toxic – lengthy exposure to elevated stress is very unhealthy. \nOn an individual level\, it can cause physical symptoms\, memory challenges\, and an inability to concentrate\, along with feelings of frustration and overwhelm. At the group or organizational level\, overly emotional workplaces have higher turnover\, more absenteeism\, challenging relationships\, and lower productivity. \nGenerally\, the emotional tone(culture) of any given organization flows from the top down. It can be difficult to make sustained changes at the organizational level using a bottom-up approach. At the team level\, however\, changes can be made and sustained by the team members. \nWhether the external change is possible or not\, individuals can protect themselves by understanding what’s happening\, and developing skills\, techniques\, and strategies that will make them\, and the workplace\, healthier. \nWHY SHOULD YOU ATTEND?\nAre you feeling Frustrated? Exhausted? – trying to deal with all the emotions that swirl around in your workplace. Feeling like you just don’t know what to do? \nSometimes it’s the same person you have to deal with day in and day out – you feel overwhelmed and just want to avoid them\, but you can’t – you have a job to do – things to get done. \nSometimes you’re blindsided – suddenly\, out of the blue someone is angry at you or accusing you – everything was going fine – then BOOM – they became unhinged – often you don’t even know why – you’re thinking “where did that come from”?\nYou dread going into some meetings/situations knowing emotions will be flying around. SUMMARY:Here We Go Again! The DOL is increasing the Overtime Threshold in 2022. How Will this Impact Employers and Employees?
DESCRIPTION:The overtime threshold is a salary level used to determine which employees are eligible to receive overtime pay when they work over 40 hours in a single workweek. The federal rules governing overtime pay were established by the Fair Labor Standards Act (FLSA)\, which also described which workers are exempt from these rules and which are not. \nFor non-exempt employees under FLSA\, the overtime rate is at least one-and-a-half times the regular rate of pay for any hours worked above 40 in a given workweek. FLSA defines a workweek as a consecutive seven-day period of time. Employers can choose to pay a higher overtime rate if they wish\, but they must meet the minimum federal standard. \nExempt employees\, on the other hand\, do not qualify to receive overtime pay. The overtime threshold and certain job duties-not job titles-classify individuals for exempt status. These roles are typically based on a yearly salary whereas non-exempt workers are usually hourly. \nWHY SHOULD YOU ATTEND?\nThe Previous overtime rule impacted Employers and employees in a way that affected morale\, changed exempt employees to non-exempt employees\, impacted salary calculations\, changed employee classification\, and made the change an administrative nightmare.\nJob descriptions were challenged\, and employee positions based on responsibilities impact the change\, not titles.\nIt’s important to correctly classify employees under the FLSA guidelines. Whether an employee will be hourly or salaried is not left entirely to an employer’s discretion\, and the distinction is not as simple as “blue-collar” or “white-collar.”\nMisclassification is one of the most common compliance mistakes. DESCRIPTION:One of the primary objectives of every auditor is to assess organizational risks and evaluate the effectiveness of the controls established by management to mitigate those risks. The Institute of Internal Auditors has set forth the standards for auditors to use in accomplishing that objective Every organization is set up to accomplish its primary business objective. Whether it is a “for-profit” organization or a “not-for-profit” organization\, there is always a primary business objective. And whenever there is an objective\, there is always the risk that the objective will not be achieved. Management has the responsibility to assess risks and establish controls to ensure that business objectives are achieved. Internal Audit has the responsibility to evaluate those controls to determine if they are adequate and effective. For the auditor\, the process starts with the development of a risk-based annual audit plan to identify the various risk areas. The risk areas are prioritized and subject to audit based on the high-level risk assessment. Each area is further subject to a more detailed review of its particular risks and controls. There are certain Institute of Internal Auditors (IIA) standards that are required in the evaluation and communication of the risk and control assessment. DESCRIPTION:OVERVIEW \nManaging leaves of absence under the major federal mandates can be confusing. Some employers with good intentions will administer both leaves by using the same forms\, overlapping the requirements\, and consolidating the processes.\nHowever\, the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA) need to be administered using their own separate guidelines.
